Expropriation

In order to achieve the planning goals the competent authorities may, under observation of the rules of expropriation, dispossess land from private entities. In the event of expropriation full compensation has to be made. Expropriation decisions may be appealed. Federal law dictates that at least one court of law on a Cantonal level has to review the expropriation on appeal. The Swiss Federal Court has final jurisdiction.

The rules of expropriation in Switzerland prescribe that expropriation is only permissible, if the expropriation:

  • is based on sufficient legal foundation
  • is in the public interest
  • complies with the principle of proportionality
  • the goal cannot be achieved by other reasonable measures
  • fully compensated
